This Privacy Notice does not apply to personal information that we collect from participants in clinical trials for which we or one of our related companies is a sponsor. WHAT PERSONAL INFORMATION DO WE COLLECT & HOW DO WE COLLECT IT?
We may collect (and in the past 12 months have collected) the following categories of personal information from or about you. We may also collect other personal information that is not specifically listed here, which we will use as described in this Privacy Notice or as otherwise disclosed at the time of collection.
- Personal identifiers such as name, alias, physical address, email address, account name, telephone numbers, IP address, mobile advertising ID, and other online or personal identifiers.
- Demographic information, such as age, gender, race, and marital status.
- Commercial and financial information such as records of the products or assistance services you have received from us, financial information (such as W2, tax return, or pay stub information if needed for participation in one of our patient assistance programs), information associated with your requests or inquiries, including for support or assistance, or any feedback you provide when you communicate with us, and account information, such as your account number, subscriptions, subscription history, health insurance information, information you store in your account, and other details about your use of the Services.
- Health information such as information about medical diagnoses, medications, clinical data, health care provider, health insurance information, health conditions, or adverse events associated with the use of certain medications.
- Professional information such as employer, job title, NPI, health system affiliation, sales data, and other professional details.
- Internet or network activity information such as your device and browser type, operating system, wireless carrier, device manufacturer and model, general location information (such as city, state, or geographic area), your browsing and search history on the Site, and information regarding your interaction with our Site, emails, and advertisements.
- Audio, electronic, and video information such as recordings and transcriptions of calls and videos with our support team, such as our patient support service line, for quality control or training purposes, to enforce our rights, and for marketing.
- Inferences drawn from personal information we collect, such as preferences for products or services you may be interested in.
Certain of the demographic and health information that we collect may be considered “sensitive” under certain applicable U.S. state privacy laws. You may have additional privacy rights regarding our processing of this information, as further described in the section titled, “WHAT PRIVACY RIGHTS ARE AVAILABLE UNDER APPLICABLE U.S. STATE PRIVACY LAWS.”
We collect the personal information listed above from various sources, including the following:
- Directly from you. We collect personal information when you provide it to us, such as when you contact us with questions, express interest in our products or services, complete a contact form, or otherwise interact with us or the Services. This also includes when you interact with us in offline settings, such as at a conference or event or by calling us.
- From third parties. We may receive personal information from third parties, such as our service providers, advertising partners, data analytics partners, distribution partners, event sponsors, publicly available sources, social media services, or data licensors/providers. We may merge or combine such personal information with other personal information we collect about you, such as if we enhance our contact databases with third party data.
- Referrals. Users of the Services may have the opportunity to refer colleagues or other contacts to us and share their contact information. Please do not provide us with another person's contact information unless you have their permission to do so.
- Automatic collection. When you visit or interact with the Services, your personal information may also be collected automatically. We, our service providers, and our advertising partners may automatically log information about you, your computer, or your device, and your activity over time on our Services and on other sites and online services, such as the personal identifiers or internet or network activity information described above. Like many online services, the following technologies may be used to facilitate some of our automatic data collection:
- Cookies, which are text files that websites store on a visitor's device to uniquely identify the visitor's browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
- Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.
- Local storage, which is used to save data on a visitor's device. We may use data from local storage to, for example, turn on web navigation, store multimedia preferences, customize what we show you based on your past interactions with our Services, remember your preferences, or measure ad effectiveness.
- Session-replay technologies, which are third-party software programs that we may use on the Site to record a video replay of user's interactions with the Site. The video replay may include, for example, users' clicks, mouse movements, scrolls, typing, and other activity taken during the session. We use these replays for research and development purposes, such as to help us troubleshoot problems with the Site, understand how users interact with and use the Services, and identify areas for improvement.
- Chat technologies, which are chat features that may be added to our Site that you can use to communicate with us or in some cases a digital "chatbot" that will help respond to your inquiries. Our chat vendors and other third parties may access and use the identifiers and internet or online activity information described above, and monitor and record your chats, for the purposes described in this Privacy Notice or as otherwise disclosed to you when you engage with such chat feature.
HOW DO WE USE PERSONAL INFORMATION AND FOR WHAT PURPOSES?
In addition to the purposes described above and elsewhere in this Privacy Notice, we collect and process personal information for the following purposes and as otherwise described at the time of collection.
To provide the Services. We process your personal information to deliver our offerings and operate our businesses, including to provide our Services and products, administer our patient services program, verify your identity and determine you eligibility for offers or promotions, communicate with you about the Services, respond to your inquiries, improve and personalize your experience on or with the Services, provide any surveys or questionnaires you participate in, provide maintenance and support, and fulfill any other purpose for which you provide personal information.
Research and development. We may use personal information for research and development purposes, such as to monitor or improve our Services, for internal business analysis, to understand and analyze the usage trends and preferences of our customers and contacts, to make our Services, products, and other offerings better, and to develop new features and functionality. As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes. To the extent that we classify such information as "de-identified," we commit to maintaining and using such information in a de-identified form and to not attempting to re-identify such information (except for purposes permitted by law).
Artificial intelligence. When operating our business, we may use services or applications that are supported by artificial intelligence (AI). For example, we may use AI-supported services to help us review and analyze the personal information that we have collected about our business contacts from various sources to better understand their needs or help us assess our relationship, for marketing, and to provide quicker, more efficient responses to your customer service requests. Unless you receive a supplemental privacy policy relating to such services, your personal information will continue to be treated in the same ways that are described in this Privacy Notice.
Direct marketing. We use your personal information to send you Sumitomo Pharma America-related or other marketing communications as permitted by law. You may opt-out of our marketing and promotional communications as described in the section titled "WHAT CHOICES DO YOU HAVE REGARDING YOUR PERSONAL INFORMATION" below.
Text messaging. If you are enrolled in or are signed up for one of our text messaging programs, we will use the mobile phone number that you provide to send you messages, including using SMS or short code technology, to share updates regarding our products and services or to otherwise communicate with you, to operate our texting program, and to manage and monitor any choices or opt-out that you may provide. No mobile opt-in information will be shared with third parties for marketing or promotional purposes, but such information may be shared with our service providers to provide texting services or as legally required.
Targeted advertising. We use certain categories of personal information for targeted advertising purposes, which is also sometimes referred to as "cross-context behavioral advertising" under certain state privacy laws. To do this, we work with third-party advertising companies and social media companies to help us advertise our business and to display ads for our Services and the products that we offer. These companies may use cookies and similar technologies to collect information about you (including certain online identifiers and the internet or network activity information described above) over time across our Services and other websites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. In addition, some of these companies may use hashed customer lists that we share with them to deliver ads to you and to similar users on their services.
Compliance, fraud prevention, and safety. WHO DO WE DISCLOSE PERSONAL INFORMATION TO AND FOR WHAT PURPOSES?
Disclosures for Business Purposes
In addition to the specific situations discussed elsewhere in this Privacy Notice or as disclosed to you at the time of collection, we may disclose (and in the past 12 months may have disclosed) any of the categories of personal information that we collect for any of the business purposes described in this Privacy Notice with the following entities or persons:
- Related entities, such as our parent company, subsidiaries, and affiliated entities.
- Service providers, such as companies that help us monitor and maintain the website, prepare newsletters, emails, and mailings, manage customer information, assist in providing our patient services program, facilitate email or text communications, provide security services and cloud-based data storage, host our website and assist with other IT-related functions, promote our products and business, or provide analytics and business intelligence information and analysis. When you enroll in one of our text message programs and provide us with your mobile information, no mobile opt-in information will be shared with third parties for marketing or promotional purposes.
- Professional advisors, such as persons, companies, or professional firms providing us with advice and consulting in accounting, administrative, legal, tax, financial, debt collection, or other matters, to the extent such information is necessary in their provision of services to Sumitomo Pharma America.
- Authorities and others for compliance, fraud prevention, and safety as required or permitted by law to comply with a subpoena, warrant, court order, or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others. We may also disclose your personal information to third parties to help detect and protect against fraud or data security vulnerabilities or as otherwise described in the "Compliance, Fraud Prevention, and Safety" section above.
- Business transaction participants in connection with any business transaction (or potential transaction) such as a merger, acquisition, sale of shares or assets, financing, acquisition, consolidation, reorganization, divestiture, or dissolution of all or a portion of our business (including in connection with a bankruptcy or similar proceedings).
Disclosures for Targeted Advertising
In addition to the specific situations discussed elsewhere in this Privacy Notice or at the time of collection, we may disclose (and in the past twelve months may have disclosed) the following categories of personal information described above for purposes of targeted advertising: personal identifiers (including, for example, email address, IP address, mobile advertising IDs, and other online identifiers), internet or network activity information, and professional information. These disclosures may be considered a "sale" or "share" under certain state privacy laws.
These categories of personal information are sold to or shared for targeted advertising purposes with advertising networks, social media platforms, data providers, and other companies that facilitate or engage in digital advertising. We engage in such sales and sharing to facilitate personalized advertising. We do so by allowing third parties to place cookies or other tracking technologies on our Site that may collect information about your online activities over time and across different websites or applications. We may also share this data, including in hashed form, with advertising networks and social media platforms as further described under the "Targeted advertising" paragraph above. HOW LONG DO WE RETAIN PERSONAL INFORMATION?
We retain personal information as needed to fulfill the purposes described in this Privacy Notice, including to provide our Services, to comply with legal obligations, resolve disputes, or to protect our legal rights or agreements, or as otherwise disclosed to you. To determine the appropriate retention periods for personal information, we may consider the amount, nature, and sensitivity of the personal information, potential risks from unauthorized use or disclosure of personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and applicable legal requirements. HOW DO WE SECURE PERSONAL INFORMATION?
No method of transmission over the internet, or method of electronic storage, is fully secure. While we use commercially reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information. You should take special care before deciding to send us information via email. If you create an account on our Site, it is your responsibility to protect your access credentials from unauthorized access or use.
DO WE TRANSFER PERSONAL INFORMATION INTERNATIONALLY?
Sumitomo Pharma America is headquartered in the United States and we have service providers in the United States and potentially other countries. Your personal information may be transferred to the United States or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as those in your jurisdiction. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein.
WHAT CHOICES DO YOU HAVE REGARDING YOUR PERSONAL INFORMATION?
All users can make the following choices regarding their personal information. Different Services may offer different phone numbers, links, or preference managers that allow you to inform us of your updates and choices, including opting out of particular communications. If you have any difficulty finding these tools or otherwise updating your data preferences, you may contact our Data Protection Officer for assistance using the methods outlined at the end of this Privacy Notice.
Review or update your account information. If you have a registered account with us, you may review and update certain personal information in your account profile by logging into the account. If the Site or Services do not permit you to update or correct certain personal information, please submit a request to us using the contact information listed at the end of this Privacy Notice. Note that we may keep historical information in our backup files as permitted by law.
Opt-out of email marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions located at the bottom of the email or by contacting us using the contact information listed at the end of this Privacy Notice. You may continue to receive service-related and other non-marketing emails.
Opt-out of text messages. We may offer communications via text messages sent by Sumitomo Pharma America or any of our service providers, such as for customer service, authentication, account-related, or marketing purposes. To stop receiving text messages from us, reply STOP to any text message you receive from us, or send your request and mobile telephone number to us using one of the contact methods listed at the end of this Privacy Notice. WHAT PRIVACY RIGHTS ARE AVAILABLE UNDER APPLICABLE U.S. STATE PRIVACY LAWS?
Applicable U.S. state privacy laws give state residents various rights with respect to personal information we collect about them, with some exceptions. - Nondiscrimination. You are entitled to exercise the rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our products and services.

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the "sale" of certain types of personal information. Subject to several exceptions, Nevada law defines "sale" to mean the exchange of certain types of personal information for monetary consideration to another person. We will respond to requests from residents of states with data privacy laws that apply to us and will do so with respect to the rights that are provided under the requestor's state law as of the effective date of that law.

To opt-out of the automatic collection of personal information via cookies and similar technologies for the purpose of targeted or cross-context behavioral advertising, please select your cookie preferences by clicking the "Cookie Preferences" link available at the bottom of the Site. Where required by applicable law, the Site also recognizes the Global Privacy Control (GPC) signal. Note that due to technological limitations, if you visit our Site from a different computer or device, or clear cookies on your browser that store your preferences, you will need to return to this screen to select your preferences and/or rebroadcast the GPC signal.
If you direct us not to "sell" or share your personal information for targeted/cross-context behavioral advertising, we will consider it a request pursuant to California's "Shine the Light" law to stop sharing your personal information covered by that law with third parties for their direct marketing purposes.
You may also designate an authorized agent to make a request on your behalf. If you do so, we may require written proof that the agent is authorized to act on your behalf and other information permitted by law. In some cases, we may also require you to verify your identity directly with us, to directly confirm with us that you provided the authorized agent with permission to submit the request, or to take other steps required or permitted by applicable law.

How We Process U.S. State Privacy Right Requests
We reserve the right to confirm your residence to process your requests and, when exercising certain of your rights or otherwise assisting you, we may need to request specific information from you to help us confirm your identity. This is a security measure to, for example, ensure we do not disclose personal information to any person who is not entitled to receive it. We may also contact you to ask you for further information in relation to your request to, for example, speed up our response.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee or decline to comply with your request if your request is clearly unfounded, repetitive, or excessive.
We try to provide a substantive response to requests to know, access/port, delete, or correct within 45 days of the date on which we receive your request, and to all opt-out and consent revocation/right to limit requests promptly and within 15 business days of your request, or such other timeframe as required by law. If we require additional information or time to process your requests, we will contact you.
How to Appeal Our Decision Regarding Your U.S. Privacy Right Request
If we decline to take action on your request, where required by law, you may appeal such refusal by following any instructions provided in our communication containing our decision or by contacting us using one of the methods provided at the end of this Privacy Notice within a reasonable time period after we sent you our decision. We will process your appeal in accordance with applicable state privacy law.

The information provided in this section applies only to individuals in the European Union, the European Economic Area, or the United Kingdom (collectively, "Europe" for purposes of this Privacy Notice). Except as otherwise specified, references to "personal information" in this Privacy Notice are equivalent to "personal data" governed by European data protection legislation.
